South Dakota Cattlemen's Association: 2026 Legislative Update

Week 5 - Halfway Through

 

We are halfway through the 101th legislative session. After a four day week, Legislators headed home Thursday evening for a four day weekend filled with Cracker Barrel events as they have President's Day off.

 

First Veto 

We started off the week with the Governor's Veto of House Bill 1077, a win for ag producers across South Dakota. Cattle producers have long been opposed to cell cultured proteins. But for the South Dakota Cattlemen's Association, HB 1077 represented a lot more than a ban on cell cultured protein. The bill set a troubling template for market access restrictions that could have been applied against traditional agricultural producers, sending a message that South Dakota was willing to ban legally regulated products based on preference rather than principle. This could have been seen as an invitation to other states to pursue legislation restricting market access for South Dakota livestock based on production methods. HB 1077 casts doubt on the very food safety inspection system that farmers and ranchers rely on to market products across the nation and around the world. Consumer confidence in the federal inspection system is essential and undermining that confidence harms all producers and consumers. Read SDCA's full statement on the veto here. 

 

Brand Board Bills 

We also focused on a pair of bills regarding Brand Board this week. HB 1264 which would have expanded the brand inspection area from west river to the entire state was defeated. HB 1020 that provides an increased fee cap for the brand inspection fee was up for final consideration, but deferred until Tuesday to allow time for additional discussions among Senators who raised some concerns about the administration of the program. Addressing some of those concerns, Governor Rhoden issued a directive to the Board to address several concerns and set a timeline to keep the board accountable. 

 

In other Brand Board news, Governor Rhoden appointed SDCA's own Kory Bierle to the Brand Board today! Congratulations Kory!! Also appointed to the Board is Ross Cuny from Buffalo Gap.

 

Bills SDCA is Monitoring  

HB 1020 Increases the maximum cap for the livestock ownership inspection fee to $1.65. SDCA Brand Committee Chair Kory Bierle provided testimony to the committee. In addition to SDCA, SD Farm Bureau, SD Stockgrowers, DANR and the Brand Board provided testimony in support of the increase. LMA was the only opponent. 

Position: Support

Status: Scheduled for Senate on 2/17

HB 1267 Seeks to require statewide brand ownership inspection starting July 1, 2029. 

Position: Oppose. SDCA has a long standing history of opposing statewide brand inspection and our policy only supports the current inspection area. 

Status: Failed 9-4-1 in House Ag Committee

Here are just a few of the other bills we worked on this past week or that we are watching: 

 

HB 1077 Considers a cultivated protein food to be adulterated. 

Position: Oppose. To define an otherwise legal and inspected product adulterated puts the food safety system at risk. These products are inspected and regulated at a federal level. SDCA and other groups worked to successfully pass stronger labeling laws in 2025 that clearly distinguished cell cultivated products so consumer can easily identify them. Status: Vetoed by Governor

 

SB 124 Imposes a 10 year prohibition the manufacture, sale, and distribution of any product containing a cell-cultured protein.

Position: Oppose. While not a ban, similar public policy concerns may exist about limiting a free market and casting doubt on food safety systems. It is unclear how the passage of 1077 will impact this measure moving forward. 

Status: Introduced

 

SB 156 Modifies the crime of cruelty to an animal in certain circumstances and increases the penalty to a Class 4 felony punishable by up to 10 years and $20,000. The general penalty for animal cruelty would remain a lesser Class 6 felony. This bill stems from a recent incident in which an animal was harmed in a manner that was especially horrific. 

Position: Oppose

Status: Passed Senate Judiciary 4-3, passed full Senate 25-8. The bill now moves over to the House Agriculture Committee. 

 

HB 1147 Makes an appropriation for the purchase and distribution of food by a statewide distribution organization. The bill appropriates $5 Million dollars to DANR to aid in statewide food distribution including the purchase of food from local producers. 

Position: Watch

Status: Introduced and assigned to Joint Appropriations 

 

HB 1294 Would prohibit geoengineering in the state. 

Position: Oppose. The bill claimed to be a preemptive measure to prohibit geoengineering/ climate modification, however even after heavily amended it had potential to also prohibit beneficial land management and ag practices because the bill prohibited activities  that remove carbon dioxide and reflect sunlight (trees, pastures, cropland... and so much more)

Status: Defeated in House Ag Committee. 

 

HCR 6016 Is a new resolution seeking reform of the Beef Checkoff, specifically in support of the OFF Act. 

Position: Oppose. Supporting the OFF Act is detrimental to not only the Beef Checkoff, but other Checkoffs that fall under USDA as well. Read Craig's editorial on the OFF Act here.

Status: Introduced
