Title:Right-of-Way Specialist - Public Works

PRIMARY RESPONSIBILITY:

Although under the supervision of the Right-of-Way Supervisor, the successful candidate will customarily and regularly perform work that affects the right-of-way unit to a substantial degree, will carry out major assignments, and will have the authority to negotiate on significant matters concerning right of way. Such work will include a variety of technical duties in the search and review of deeds, titles, and legal descriptions necessary for property acquisition and assist in the negotiations for the acquisitions or use of property by the County. Note: This position is open until filled.
EXAMPLES OF IMPORTANT AND ESSENTIAL DUTIES:
 Determine right-of-way concerns affecting the County; determine location of right-of-way.
 Prepare and maintain a complete set of records in regard to right-of-way legal descriptions, transactions, deeds, agreements, and other related documents; review documents prepared for County acceptance.
 Answer questions and provide information to the public regarding property boundary issues, County property rights, and general easements; contact property owners to explain activities affecting right-of-way; provide acquisition information to the appropriate interested parties; prepare and distribute information to promote acceptance and understanding of property acquisition and disposition.
 Review requested right-of-way abandonment (vacation); notify affected departments and public utility companies; assist public utility companies in acquiring necessary rights through County owned properties.
 Secure deeds, easements, and agreements necessary for the acquisition of, or use of, property by the County.
 Prepare resolution for Board of County Commissioners and Planning Commission approvals; prepare necessary exhibits.
 Review title reports to verify proper title is being transferred to the County, perform
title searches to determine validity and adequacy of existing right-of-way
dedications.
 Prepare encroachment agreements and right-of-way licenses.
 Write resolutions and concise history and facts for Board of County Commissioners
action.
 Perform title searches.
 Documentation and legal procedures necessary in obtaining property and easements.
 Determine right-of-way and easement requirements.
 Prepare value findings and review the work of contracted appraisers.
 Perform other duties and responsibilities as required.
Qualifications:Knowledge, Skills and Abilities:
 Ability to interpret and apply Federal, State, and local policies, procedures, laws, and
regulations.
 Knowledge of principles, practices, and procedures of real estate title search.
 Knowledge of legal and real estate terminology and conditions of title.
 Knowledge of procedures and techniques for correct legal document preparation.
 Knowledge and skills in real estate law and its principles, real estate appraisal
techniques, and the ability to read architectural and engineering construction plans.
 Knowledge and skills in boundary control principles and surveying.
 Knowledge of the principles of drafting and layout.
 Knowledge of the principles of mathematics including geometry and trigonometry.
 Ability to read, write, and interpret difficult legal descriptions in conformance with
standard practice.
 Ability to read and interpret maps, survey notes, legal descriptions of property, plot
plans, and profiles.
 Skills to perform moderately difficult mathematical computations.
 Skills to keep records and prepare clear, concise, and complete written and oral
reports.
 Ability to communicate clearly and concisely, both orally and in writing.
 Ability to establish, maintain, and foster positive and harmonious working
relationships with those contacted in the course of work.
 Computer Skills: Knowledge of MS Office Suite, ability to learn ArcGIS, use of
AutoCAD, or Civil3D.
REQUIREMENTS:
 Experience: Two (2) years of responsible title searching and examination, property
acquisition, real property appraisal, reading, writing, and drafting legal descriptions
and other related technical real estate work experience.
 Education and Training:
o High school diploma or GED equivalent required.
o Bachelor's Degree in engineering, surveying, or a related field preferred.
 License or Certificate:
o Possession of a Land Surveyor-in-Training certification or better.
o Possession of a valid driver's license.
 Background Check: Must pass a criminal background check.
